DELHI PROPERTY OWNER'S TAX VALUATION GUIDE

What Delhi Assessing Officers Look For in Section 34AB Certificates

A defensible Section 34AB valuation certificate is not simply a number. For a Delhi property, the supporting evidence can matter just as much — particularly where the certificate establishes a historical 1 April 2001 fair market value for capital-gain purposes.

Locality, property type, registered transaction evidence, adjustment methodology and the relationship between the subject property and comparable properties can all become important when a valuation is examined.

THE DELHI SCRUTINY LENS

Delhi Property Valuation Needs Local Evidence.

Delhi has sharply differentiated property micro-markets. A Malviya Nagar builder floor, a Greater Kailash property, a Lal Dora / urban village property and a DDA property may require different comparable evidence and different adjustments.

The Income Tax Department's Jurisdictional Assessing Officer framework allows taxpayers to identify the applicable jurisdiction, range and AO for a PAN. In practice, a valuation certificate should therefore make its evidence sufficiently transparent for the relevant authority to understand and independently examine.

✓
The central principle

The more clearly the certificate connects the subject property, comparable evidence, adjustments and final FMV, the easier it is to understand the reasoning behind the valuation.

WHAT THE CERTIFICATE SHOULD CONNECT
01
SUBJECT

The Property

Location, property type, area, title / tenure and relevant characteristics.

02
MARKET

The Comparables

Registered transactions relevant to the subject's locality and property segment.

03
ANALYSIS

The Adjustments

Floor, size, location, condition and other adjustments with an explained basis.

04
CONCLUSION

The FMV

A conclusion that can be traced back to the underlying evidence.

FIVE COMMON CHALLENGE PATTERNS

What Can Be Questioned — And How the Evidence Should Respond.

These are practical scrutiny questions that can arise when historical property valuations are examined. The objective is not to predict an AO's decision, but to make the valuation record clear, traceable and evidence-led.

01 LOCALITY

The Comparable Is From a Different Locality

POSSIBLE AO QUESTION

Is the cited transaction genuinely comparable to the subject property, or is it from a different Delhi market micro-segment?

A
A2Z PREPARATION

Use the closest available registered comparables within the same colony or relevant Sub-Registrar area. Where adjacent-locality evidence is necessary, explain the inter-locality adjustment.

02 FMV

The 1 April 2001 FMV Is Considered Too High

POSSIBLE AO QUESTION

Is the historical 1 April 2001 fair market value supported by sufficient evidence?

A
A2Z PREPARATION

Connect the conclusion to registered historical transactions, locality-specific adjustments and the documented range of the comparable evidence.

03 ADJUSTMENTS

The Adjustment Factors Appear Subjective

POSSIBLE AO QUESTION

What evidence supports the adjustment for floor, size, location or other property differences?

A
A2Z PREPARATION

Document the basis for each material adjustment and relate it to the specific Delhi locality and market evidence rather than presenting an unexplained percentage.

04 PROPERTY TYPE

The Property Type Is Unusual

POSSIBLE AO QUESTION

Are general registered-market comparables appropriate for a Lal Dora, DDA or group housing property?

A
A2Z PREPARATION

Address the subject property's specific characteristics and explain relevant marketability, conveyance or tenure considerations.

05 DVO

The Matter Is Referred to the Departmental Valuation Officer

POSSIBLE AO STEP

The matter may move into a valuation-officer assessment process where the Department seeks an independent valuation.

A
A2Z PREPARATION

Maintain the supporting comparable documentation and valuation reasoning so that the evidence can be explained if a subsequent valuation assessment differs from the original conclusion. Any further tax proceedings should be handled with the taxpayer's CA / tax counsel.

BUILD THE EVIDENCE BEFORE THE QUESTION

Preparing a Delhi Property Valuation Certificate?

If your property valuation is connected with Section 55(2)(b), capital gains, Section 50C, inheritance or an unusual Delhi property type, discuss the property and documentation before the certificate is prepared.
