DELHI PROPERTY OWNER'S GUIDE

Frequently Asked Questions from Delhi Property Owners

From Section 55(2)(b) certificates and Section 50C circle-rate questions to DDA flats, Lal Dora properties, NRI inheritance and AO scrutiny — these are some of the practical valuation questions Delhi property owners ask before taking their next step.

BEFORE YOU COMMISSION A VALUATION

The Right Question Comes Before the Certificate.

A Delhi property valuation is not simply about placing a number on a property. The relevant valuation date, property type, title position, transaction purpose and statutory requirement can all affect the scope of the engagement.

Whether you are selling, inheriting, preparing a Section 55(2)(b) certificate, checking Section 50C exposure or preparing an NRI property sale, start by identifying exactly what the valuation needs to establish.

Questions Delhi Owners Ask Before Selling

01

Do I need a Section 55(2)(b) certificate if I’m selling my South Delhi property?

If you acquired the property before 1 April 2001, your CA may recommend establishing its fair market value as on 1 April 2001 for capital-gain computation. A professional valuation can help establish the historical value used in the relevant tax calculation.

For properties acquired on or after 1 April 2001, Section 55(2)(b) does not apply to that pre-2001 valuation date. However, Section 50C may still need to be considered when assessing the relationship between the sale consideration and the applicable stamp valuation value.

KEY POINT Ask your CA to confirm the applicable valuation date and tax treatment before sale.
02

How long does a Government Approved Valuation for my Delhi property take?

For a standard Delhi residential property such as a builder floor, flat or independent house, a typical engagement may take approximately 7–10 working days from the engagement stage to certificate delivery, subject to site inspection, document availability and comparable research.

More complex properties — including Lal Dora properties, NDMC leasehold, multi-floor builder properties or other unusual title situations — may require approximately 10–15 working days.

Urgent requirements, including certain Section 197 LDC matters or time-sensitive tax proceedings, can be discussed on a priority basis.

03

What is the fee for a Government Approved Valuation in Delhi?

The professional fee depends on the property type, statutory context, valuation date and engagement scope. A standard residential valuation and a complex historical or statutory assignment may therefore require different levels of research.

A2Z Valuers provides a fee estimate after receiving a brief description of the property and the reason for valuation. A standard Section 55(2)(b) valuation is priced according to the professional work and research required rather than simply being calculated as a percentage of the property's market value.

04

Can you value a Lal Dora / Urban Village property in Delhi?

Yes. Lal Dora and extended Lal Dora properties form a distinct category within Delhi's property landscape and may require different comparable evidence from properties in planned colonies.

The valuation assessment can address the relevant marketability considerations, title/document position and fair market value evidence. Where a statutory comparison such as Section 50C is relevant, the applicable facts and valuation context should be examined rather than assuming that one methodology fits every property.

Questions That Arise After the Property Gets Complicated

05

I’m an NRI selling a Delhi property I inherited. Do I need to come to Delhi?

An NRI does not necessarily need to be physically present in Delhi for the valuation engagement. Subject to the documents and site-access requirements, the valuation process can be coordinated remotely.

Documents such as title deeds, allotment letters and identification/passport documents can be shared digitally. A site inspection can be coordinated locally, while the valuation certificate can be delivered electronically.

Where relevant, the valuation engagement can also be coordinated with the owner's Delhi CA for Section 197 LDC support and the broader sale process.

06

My DDA flat has no conveyance deed. Can it still be valued?

Yes. A DDA flat can be considered for valuation even where an executed conveyance deed is not available, provided the available documentation and rights position can be properly examined.

The certificate should clearly identify the conveyance status, allotment history and relevant documentation. Where a value adjustment is appropriate because of the particular rights or documentation position, the basis should be explained rather than presented as an unexplained deduction.

If the conveyance process is already underway, that status may also be recorded as part of the valuation context.

07

What is the Section 50C risk for my Delhi property sale?

This should be checked before signing the sale agreement. Section 50C can become relevant where the stamp valuation authority value needs to be compared with the actual sale consideration for an immovable property.

For a Delhi property, the practical assessment can require examination of the locality, applicable circle-rate framework, property type, proposed sale consideration and relevant valuation evidence.

If you are concerned about a potential Section 50C issue, provide the locality, property type and proposed consideration when discussing the engagement so the appropriate valuation route can be considered.

08

Will my Section 55(2)(b) certificate be accepted at AO scrutiny?

No valuation certificate can guarantee how an assessing authority will treat a particular case. However, a professionally prepared report can be structured with clear supporting evidence and methodology.

A2Z Valuers' approach is designed to document the relevant comparable evidence, valuation methodology, adjustment rationale and statutory context so that the basis of the valuation can be understood if questions arise.

Depending on the engagement, supporting material can include Sub-Registrar-referenced comparable evidence, methodology notes, relevant statutory framing and the applicable professional declarations.

If the Delhi AO raises questions about a valuation report, the appropriate response depends on the case and should be coordinated with the taxpayer's CA/tax representative.
