Premium Delhi Zones
If your property falls within a premium or mid-premium Delhi locality, check the applicable SDV before relying only on the negotiated market price.
When you sell a Delhi property, the sale consideration agreed with the buyer is compared with the applicable Stamp Duty Value (SDV) used for Section 50C purposes.
If the applicable SDV is higher than the permitted threshold in relation to the declared sale consideration, the tax computation can be affected. That is why a Section 50C check should be made before the sale documentation is finalised.
“What is the circle rate?”
The practical question is:“How does the applicable SDV compare with my proposed sale consideration?”
Check the applicable Delhi circle rate / SDV against the proposed transaction value before proceeding.
The check becomes particularly important when the property, location or proposed consideration creates a meaningful difference between the declared sale price and the applicable Delhi SDV.
If your property falls within a premium or mid-premium Delhi locality, check the applicable SDV before relying only on the negotiated market price.
Commercial properties can have materially different valuation and SDV considerations. A Section 50C assessment should be made against the property-specific facts.
Where the applicable Stamp Duty Value exceeds 110% of the declared consideration, the Section 50C implications need to be examined carefully.
The most useful time to identify a potential Section 50C issue is before the transaction documents and tax computation are finalised.
A2Z Valuers can review the applicable Delhi circle rate / SDV, the proposed sale consideration and the basic property facts to identify whether a deeper FMV assessment may be required.
